1. METHOD OF CATALOGUE LISTING

2. SALES PROCEEDS AND CESSION OF RIGHTS

Guaranteed payment of sales proceeds will be made to vendors 45 days after the sale.

The vendor agrees that Cape Racing Sales shall only pay sale proceeds directly into the nominated bank account listed below. If acting as agent for a third party, a separate entry form is to be completed, otherwise the vendor undertakes to account to the registered owner directly. The vendor hereby cedes, makes over and transfers to Cape Racing Sales all of its rights, title and interest as seller against the buyer in respect of the sale of the horse(s) entered and sold under the conditions of sale of Cape Racing Sales. This cession by the vendor includes but is not limited to the right of Cape Racing Sales to institute legal proceedings and to recover in its own name the purchase consideration(s) and related costs and expenses of such horse(s) sold from the relevant buyer(s).

Please EFT payment to Cape Racing Equine (Pty) Ltd. An acceptance fee of R3250+VAT is payable on acceptance of each lot catalogued in the sale. Please note that this payment is due on the 6th November 2024, without full payment the lot will not be catalogued in the sale. Please note: All horses will be re-inspected at the discretion of Cape Racing upon arrival at the sales grounds. Cape Racing retains the right to remove any horses from the sale should it be deemed necessary for whatever reason.

CAPE RACING (CR) - CONDITIONS OF NOMINATION

NOTES

  • Nominations close on 27th September 2024..
  • Only horses registered in the General Stud Book of South Africa at the time of the sale will be auctioned.
  • Unregistered horses may be refused access to the sales venue.
  • CRS reserves the right not to accept entries from any vendor who, for whatever reason, is indebted to it.
  • This form must be signed and completed as directed and emailed to ann@caperacing.co.za by 27th September 2024.
  • CRS reserves the right to change conditions pertaining to the sale.
  • Vendors are advised that professional conformation photographs and walking videos of each lot are a condition entry of the sale. Cost is to the vendor.

 

1. GENERAL

1.1.  The Vendor is responsible for ensuring that all horses entered are fit for sale and are delivered to the sale venue free from contagious and infectious diseases.

1.2.  The Vendor must deliver NHRA Regulation Passports to the CR Sales Office on arrival at the sales venue. It is an express condition of entry that all horses are vaccinated in accordance with the rules of the NHRA of South Africa. (In this regard special mention is made of A.H.S. and Equine flu.).

1.3.  CRS, in conjunction with the selection, inspection and scrseening panels, reserves the right to:
1.3.1. accept or reject any nomination.
1.3.2. reject any horse that was previously accepted for the sale.

1.4.  CRS shall be entitled to deduct from the proceeds of the horses hereby entered any amount which may be due to it by any party for whom the vendor acts or has acted as agent.

1.5.  All horses will be re-inspected at the discretion of CRS upon arrival at the sales grounds. CRS retains the right to remove any horse from the sale should it be deemed necessary for whatever reason.

1.6 Vendors will be obliged to use CRS approved photographers and videographers. The stud farms will be advised when the visits will be made. This is to insure that all photos and videos are up timeously.

1.7.  The vendor declares that he/she/it is the registered owner of all horses sought to be entered hereunder and if not, he/she/ It is acting on behalf of the registered owner(s) of all horses thus entered. In the latter instance the name of the registered owner(s) is 

2. ACCEPTANCE FEE
An acceptance fee of R3,250 + VAT is payable for each lot which is catalogued. Please note that this payment is due on the 6th November 2024, without full payment the lot will not be catalogued in the sale. The acceptance fee includes:

  • Groom on-site accommodation for night watchmen
  • Vendor drafts showcased via Cape Racing Media.
  • Sporting Post and Turf Talk articles included in the build up to the sale.

2.1  SALES LEVY
A sales levy will be charged at the rate of 6% (excl. VAT) on the selling price for each lot sold. In the case of a horse not sold in the ring, the sales levy of 2% (excl. VAT) will be payable on the reserve price, should CRS decide to accept reserve prices. In the event of no bid, the sales levy of R1,000 (excl. VAT) will be payable.

2.2  VENDOR RACE LEVY
A Race Levy of R5000.00 will be charged to the Vendor.

2.3 BUYER’S LEVY
A compulsory, buyer’s levy of 2% applies.

2.4 RACE LEVY
2.4.1 A compulsory R10 000 CRS levy applies to the buyer. All 2025 Summer Sale, 2025 CPYS, 2025 WYS and 2025 Breeze Up and Unbroken 2YO Sale graduates are for eligible for the 2026 CRS Slipper, 2027 CRS Sprint and the 2027 Mile.
2.4.2 A Cape Racing Bonus levy of R5,000 applies to buyer. The CRS Bonus is a juvenile bonus incentive for all graduates. Bonuses of R100,000 will be paid for the first juvenile win of ANY race, and this will be payable not only in Juvenile races, but with wider reach to include open Maiden races won by juveniles. R75,000 will be paid to the winning owner and R25,000 to the winning vendor. The vendor bonus will be paid out to the original vendor from the initial Cape Racing Sales auction from which the horse was sold. Bonuses are limited to the first 40 juvenile winners .

2.5 INTEREST
Interest will be charged at 2% per month on late payments. .

3. PENALTY LEVY ON WITHDRAWAL
If a horse is withdrawn from the sale, for any reason whatsoever, except if a veterinary certificate certifying that the horse is unfit for sale due to injury or illness is produced, the vendor undertakes to pay CRS the levy calculated on the average price of all lots sold at the sale. Such veterinary certificates must be lodged with the auctioneer or CRS prior to commencement of the sale. A certificate lodged after the close of the sale, will not be considered and all levies will in such event become due and payable.

4. PEDIGREE COMPILATION
All pedigrees will be compiled by the Auctioneers and the cost thereof is included in the acceptance fee. Vendors must examine the pedigrees of their entries submitted to them and report any corrections/inaccuracies to CRS not later than 6th November 2024

5. MINIMUM PRICE
The minimum price which will be accepted for any horse in the sales ring is R50,000.

NOTE: The provisions hereof are supplementary and subject to the terms and conditions of the sale contained in the catalogue that will be published prior to the sale. Entries are accordingly submitted on that basis.
